The state of Texas has very specific rules regarding who can file a wrongful death lawsuit. Parents, children, and spouses of the deceased can file wrongful death claims, while siblings and grandparents cannot. Children are allowed to file a lawsuit even if they are over the age of 18 and no longer legal dependents. If no family members file a wrongful death lawsuit within three months of the death, an executor of the deceased’s estate can file suit on behalf of the estate. Surviving family has two years from the date of their loved one’s passing to file suit.
